How to fix a wrong mortgagee clause on a homeowners insurance binder

Resend the lender’s legal name, “its successors and/or assigns,” the insurance mailing address, and the loan number in one written request. Ask the agency for a revised binder or declarations page with mortgagee checked. Fannie Mae Selling Guide B7-3-08 (12/14/2022) will not take a loss payable clause in lieu of a mortgagee clause.

This is for the processor or processing manager at an independent mortgage bank on Encompass whose HOI row is still open prior to docs because the mortgagee line on the binder came back wrong. The counterparty is the insurance agency. Pull the conditions list, the binder or declarations page already in the eFolder, the lender’s legal name, the mailing address, and the loan number.

Name the miss before you email

Circle one miss. Then ask for that miss. A second letter that restates the whole overlay list is how agencies start shredding the file.

FHA servicing text names the mortgagee as a “Loss Payee” on hazard insurance, which is why agents keep checking that box. On a Fannie-eligible file, the checkbox still fails B7-3-08. HUD Handbook 4000.1 (read 2026-10-09) wants Evidence of Hazard Insurance in the case binder. Ask for mortgagee.

One written block is the request

Agencies treat a complete written request as minutes of work and a last-minute close-date change as a different job. On r/InsuranceAgent in June 2025, one shop posted that it will not complete a binder without a written request and an authorization form, and that it sends the binder within two business days of receipt. Put one file in one email.

Paste this block as the body, not as an attachment the agency has to retype:

  1. Lender or servicer legal name, the name on the conditions list, not a DBA.
  2. The phrase “its successors and/or assigns” (ISAOA).
  3. The insurance-processing mailing address, usually a P.O. box.
  4. Loan number.
  5. Closing date, and whether this is a purchase or a refinance.
  6. The ask: a revised binder or declarations page with the mortgagee checkbox, not loss payee.

IRMI (read 2026-10-09) treats a mortgagee clause as a separate contract between the insurer and the named mortgagee. Loss is payable to that mortgagee. The insurer has to give it advance written notice of cancellation. Coverage for the mortgagee can continue even when an act of the insured voids the insured’s own claim. Typing the lender next to loss payee does not create that contract.

What an insurance binder should include for a mortgage is the rest of the binder. Keep this email on the additional-interest block. Email or fax the agency’s published intake.

The agency will not change a refinance without the insured

The named insured owns the policy. On r/Insurance in March 2020, agents said they confirm a refinance change with the policyholder because a small shop once asked to be added on a loan the borrower never intended to close. Attach the shop’s insurance-authorization form, or copy the borrower on the same email so the agency can confirm.

The old servicer stays on the policy until this lender’s clause is endorsed. Some agencies add this lender as of the closing date and leave the prior lender until payoff. Take a binder that names this lender as mortgagee with an effective date on or before closing. A prior servicer in the mortgagee field is a bounce.

On X in July 2026, a landlord-lending operator described a review loop whose usual misses were a missing loan number and an incorrect mortgagee clause. Send both in the first correction, even though only the clause is a Guide field.

A markup on the PDF is not a revised binder

Do not annotate the binder yourself. Ask for a reissued ACORD 75 or declarations page. Underwriters bounce handwritten “ISAOA” in the margin, a typed overlay on a scan, and a quote that was never bound.

On r/Insurance in August 2020, an agent said a revised declarations page is available in minutes most of the time. On r/InsuranceAgent in June 2025, producers said they shred a “correct this” letter when their notes already show they sent the dec. If the agency already sent a correct clause, stop. Compare the additional-interest block to the conditions list before you resend.

A quote in place of the revised binder still leaves HOI open. Fannie Mae Selling Guide B7-3-07 (08/05/2026) wants evidence of a valid policy, or a certificate of property insurance signed by the insurer.

A truncated name on two lines can still clear

On r/InsuranceAgent in June 2025, producers said a long servicer name overflows the carrier field, and they finish it on the address line before the P.O. box. Take it if this lender is readable across those lines. If the underwriter cannot match the conditions list, resend the full block and ask them to overflow rather than truncate.

An extra ATTN line or a ZIP+4 is not a miss. On r/Insurance in August 2020, a servicer bounced a KeyBank clause over “ATTN Insurance Admin” and a longer ZIP. The agent called that an easy endorsement. Compare against the legal name, “its successors and/or assigns,” and the P.O. box, not against a character-for-character overlay.

ATIMA (“as their interests may appear”) is still overlay. Freddie Mac Guide 4703.6 uses “its successors and assigns,” without ATIMA. Do not hold a conventional file for a missing ATIMA when ISAOA, the legal name, and the mailing address are already there.

A condo master names the HOA. Put the standard mortgagee clause on the unit HO-6. What a mortgage lender needs from the homeowners insurance agent before closing is the rest of the HOI packet.

Pull the binders and declarations pages that still have an open mortgagee-clause condition. Circle the one miss, paste the legal-name block into one email to the agency, attach the shop’s authorization form if they require it, and log the sent date on the file that afternoon.
